The ESI Act, 1948, mandates ESI registration for certain establishments, ensuring that employees earning up to a specified wage limit receive medical and cash benefits. Both employers and employees contribute a small percentage of wages to the ESI fund.

ESI Applicability & Contribution Rates

Applicability of ESI Act
- The ESI Act applies to all factories employing **10 or more persons**.
- It also extends to shops, hotels, restaurants, road motor transport establishments, newspaper establishments, educational institutions, and private medical institutions employing **10 or more persons** (or 20 or more in some states/areas, depending on state notification).
- For an establishment to be covered, the wage of an employee should not exceed **₹21,000 per month** (or ₹25,000 for persons with disability).
- Once an establishment is covered, it remains covered even if the number of employees falls below the threshold.
It's crucial for businesses to determine their applicability to avoid penalties for non-compliance.
Current ESI Contribution Rates (effective 1st July 2019)
The total contribution to ESI is 3.25% of the wages, split between employer and employee:
- **Employer's Contribution:** 3.25% of the gross wages payable to the employee.
- **Employee's Contribution:** 0.75% of the gross wages payable to the employee.
**Exemption for Low Wage Earners:** Employees earning **up to ₹175 per day** are exempt from paying their share of contribution. However, employers are still required to contribute their share for such employees.
These contributions are deposited by the employer within 15 days of the month following the month in which the wages fall due.

- Bank account statement and cancelled cheque of the company.
- Commencement of Business Certificate (if applicable).

- PAN Card of all Directors/Partners/Proprietor.
- Aadhaar Card of all Directors/Partners/Proprietor.
- Digital Signature Certificate (DSC) of the authorized signatory.
- Address Proof (Voter ID, Driving License, Passport, etc.) of all Directors/Partners/Proprietor.
Other Necessary Information/Documents
- List of employees, their date of joining, father's name, salary, and contact details.
- Proof of address of the establishment (e.g., Rent Agreement/Lease Deed, Electricity Bill, latest Property Tax Receipt).
- Factory/Shop & Establishment Act Registration Certificate.
- First purchase bill and first sales bill (if applicable).
- Month-wise total wages paid to all employees.
