Step-by-Step Trademark Registration Process in India

1. Trademark Search
Conduct a thorough search on the Indian Trademark Registry database to check for the availability and distinctiveness of your proposed trademark. This helps identify similar existing marks and reduces the chances of objection.
2. Filing the Application (Form TM-A)
Prepare and file the application in Form TM-A with the Registrar of Trademarks. This involves providing applicant details, trademark representation, description of goods/services, and claiming priority/prior use if applicable. An application number is generated upon successful filing, allowing use of the ™ symbol.
3. Examination by Trademark Office
The Trademark Examiner reviews the application for compliance with the Trademarks Act, 1999, and checks for similarities with existing marks. If objections are raised (Examination Report), a response must be filed within a stipulated time frame (usually 30 days).
4. Publication in Trademark Journal
If the application is accepted by the examiner (either initially or after overcoming objections), the trademark is published in the official Trademark Journal. This allows any third party to file an opposition against the registration within 4 months.
5. Opposition (if any) & Hearing
If an opposition is filed, the applicant must file a counter-statement. The Registrar may then schedule a hearing to resolve the matter. If no opposition is filed or if it's successfully overcome, the application proceeds to the next stage.
6. Registration & Certificate Issuance
Once the application successfully navigates all stages (no opposition or opposition overcome), the trademark is registered, and the Registrar issues a Certificate of Registration. Upon receiving this, you can start using the ® symbol.
